NCR-043-2020
Pursuant to subsection 5.9(2) of the Aeronautics Act, after having determined that the exemption is in the public interest and is not likely to adversely affect aviation safety or security, I hereby exempt any person from the charges set out in Item 1 of Schedule I of Part I, Subpart 4, related to section 104.01 of the Canadian Aviation Regulations (CARs) if that person has applied for an exemption to the CARs.
Item 1 of Schedule I sets out charge to be imposed in respect of the issuance of a ministerial exemption under subsection 5.9(2) of the Aeronautics Act.
The relevant CARs provisions can be found in Appendix A.
Purpose
The purpose of this exemption is to mitigate the financial pressures for persons requesting an exemption to the CARs as a result of the economic environment created by the COVID-19 pandemic.
Application
This exemption applies to any person that has submitted a request for an exemption to the CARs under subsection 5.9(2) of the Aeronautics Act.
Conditions
There are no conditions related to this exemption.
Validity
This exemption is in effect until the earliest of the following:
- a) December 31st, 2020, at 23:59 (EST); or
- b) The date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to adversely affect aviation safety or security.

General
104.01 Subject to section 104.03, the charge imposed in respect of the issuance, renewal, amendment or endorsement or, in the case of a medical certificate, the processing, on or after January 1, 1998 of a document referred to in column I of an item of Schedules I to VII to this Subpart is the charge set out in column II of the item.
